An Immigration and Customs Enforcement officer shot and injured a food delivery driver in Austin, Texas, on Sunday afternoon, in an incident that comes just two months after a fatal shooting by immigration agents in the state during an enforcement operation.

In a press conference on Sunday, Austin mayor Kirk Watson confirmed the shooting and said the person was taken to a local hospital with a gunshot wound and is in a stable but serious condition.
Watson, a Democrat, demanded that the city’s police department be involved in the investigation into the shooting as he expressed concern about the “credibility” of ICE conducting the investigation.
Kate Lincoln-Goldfinch, an immigration lawyer representing the man identified him as Wilber Rafael Garces Perez from Venezuela, both CNN and Texas Tribune reported.
Lincoln-Goldfinch noted that Garces Perez previously held a valid work permit in the U.S. and the CNN report added that he was working as a DoorDash delivery driver when the incident occurred.
Garces Perez was released from the hospital on Sunday evening and is now believed to be in federal custody, the reports added.

In a post on X, Rep. Greg Cesar, D-Texas., wrote: “ICE shot Wilber Rafael Garces Perez in Austin. He’s been taken out of the hospital and into ICE custody. If ICE deports him, the key witness to their shooting disappears. He must not be removed from this country, and he must receive proper medical care.”

During the press conference, Austin Police Chief Lisa Davis said the man was shot by an ICE agent following a “small foot pursuit” but warned this information was preliminary. Davis said he was hit in the torso by a bullet. In a series of Instagram posts, Lincoln-Goldfinch complained that Garces Perez’s wife was not allowed to see him at the hospital and she wasn’t told whether he was dead or in stable condition. Photos and reports showed a damaged blue car believed to belong to Garces Perez at the site of the shooting. The vehicle’s front passenger door was damaged and there appear to be bullet hole in one of the rear windows. Dozens of protesters gathers at the site of the shooting and were seen chanting and holding up signs calling out ICE.
